What is a Digital Signature?

Digital Signature Law

There is no single specific law that deals exclusively with “digital signatures” in Brazil. What exists is a set of regulations that govern different types of electronic signatures.

The main one is Provisional Measure 2,200-2/2001, which established ICP-Brasil, the Brazilian Public Key Infrastructure, the basis for digital signatures with electronic certificates.

However, this Provisional Measure does not limit the validity of other ways to prove authorship and integrity of electronic documents. Article 10, paragraph 2, establishes that other electronic authentication mechanisms may also be used, provided they are accepted by the parties involved.

In addition, Law 14,063/2020 organizes electronic signatures in Brazil, classifying them as simple, advanced, and qualified, especially in the context of interactions with public entities.

Decree 8,539/2015 also reinforces the possibility of using other authentication methods in electronic processes within public administration, such as login and password.

In practice, although digital signatures do not depend exclusively on ICP-Brasil in many contexts, some bodies and specific situations may require the use of a qualified digital certificate.

How Digital Signatures work

How does document authentication work?

When a document is created, it undergoes electronic authentication using the SHA-256 algorithm, which generates a unique code called a hash. This contributes to document integrity and makes tampering more difficult.
